    @8:28 I remember having this conversation with my dad, who is a lawyer. He talked about the defence attorney for Paul Bernardo (Canadian Case). My father said, the lawyer did his civil duty as a member of the bar and gave Bernardo a the best defence he could. But when the trial was over he came out and said to reporters something along the lines of “that’s a sick boy”.

    Part of a fair trial is a good defence. It’s a balancing act. Doesn’t matter what they believe about their client. But I imagine most believe in the process, that’s why they do it.

    Why do judges get to spend weekdays playing golf when they should be sitting in session instead of letting people who are pressumed innocent sit in jail for over 2 years? Lawyers are not to blame but our judges are. Really most of the state/federal legal system is to blame. Needs to be ripped apart and restructured.

      Judges don’t like it either, I assure you. Our court system is chronically backed up and has been for decades. It’s underfunded and flooded with cases. We need to invest probably billions of dollars into fixing the problem. Judges I’m sure would love to get things moving quicker if they could, they hate having their time wasted.

    Viva Frei has done several rebuttals to Legal Eagle’s really bad legal takes. IMO, Legal Eagle is grossly overrated.

    I wish devin addressed that even the most well known “frivolous” lawsuits are actually just propaganda. If you look into many of them, such as the McDonald’s hot coffee incident, it isn’t frivolous in the slightest.

    The law isn’t complicated. If anything, it’s dangerously simple and literal. See the recent case where a senator (?) partially redacted select letters and numbers of a sentence in a proposed bill so that it spelt out a funding increase for education for 427 years instead of just 4-6 or whatever it was.

    Another thing about appealing, as far as I know in most or all jurisdictions in the US at least, appeals can only happen based on matters of law and procedure, NOT on matters of Fact. So something in the trial process has to have been done wrong, or that a law or sentence is unjust for you to get an appeal, not just that you don’t like the verdict.

    I asked a friend who wanted to be a defense attorney about how they would feel defending someone they know is guilty. And they said, “Id rather let a guilty person go free, than put an innocent person behind bars.” which I think is a great defense of the ethical dilemma.

    Is part of the expense of a lawyer also the cost of square footage involved, versus the income potential per square foot? You’ve got a lawyer, paralegals, etc. occupying a space at commercial real estate rental prices but the number of clients they can handle at a given time is much less than a call center, etc. to divide the needed income among clientele.

    8:01 a good example of language being important is in the ACA all birth control and pregnancy parts are covered under the Women’s Health section. The unintentional consequences of this is that insurance cut all coverage of male focused birth control which caused pharmaceutical companies to stop researching them because it was more cost effective and secure to focus only on female focused birth control.

    “Only the guilty plead the 5th” Even the innocent should. Nothing you say can be used for you and will be thrown out as heresy if it’s in your favor. Therefore all talking does is potentially help the prosecution prove your guilt and you don’t need their job for them.

    hate speech might be legal in the US under the first amendment.
    But it’s not legal in other countries, like Canada. Keep that in mind, conservatives. US laws don’t apply outside of the US.

    Defendant 1: rich guy. Defendant 2: poor guy. Both commit the same crime in the same way. Def 1 gets the best lawyer and Def 2 gets a crappy one. Def 1 gets 2 years at a minimum security prison and is out on parol in 15 months. Def 2 gets 20-life. I think this is where AI can make some inroads. Both deserve 20-life and the “quality” of the lawyer should have no bearing on the case.

    Opinion is AI will assist lawyers and lower their cost. Lots of firms and lawyers already have someone read things for them. Now an AI can offset that labor cost. And help those people. So a lawyer can hire someone that navigates an AI instead of hiring people that read for them.

    A very interesting part of using the 5th Amendment is how people will automatically perceive a person who uses it to be guilty. The question becomes, “Why would an innocent person plead the fifth?” This is why, by law, juries are not allowed to use the fact that a person pleads the fifth as an indicator of guilt in deliberations. However, it IS allowed in civil trials. So if a person pleads the fifth in criminal court, it can open them up to liability in civil court. Trump is most likely going to find that out after pleading the fifth in his deposition about 400 times.

    Ahh. Law. It’s so unbelievably complex and difficult, that even minor social offenses are argued for hours. (Commonly something like a customer pointing out what was wrong with their order, and the establishment saying “there’s no problem here” and the customer is still paying full price)

    Regarding that question about eliminating instruction: but what if the the evidence you just showed might be decisive (example: a video of the defendant literally doing the crime) but acquired in some illegal way. What happend then! The evidence will be rejected right? Will the judge pretend that person is not guilty even tho they know they are?

    A lawyer is much like researcher or even a specific kind of scientist. They only know so much of a particular law but know enough of other things to allow them to do their job. It seems like each case makes them even more aware of even more laws, eventually.

    Nothing in the law requires the police to tell you your rights before you can exercise your rights, their permission is not necessary.

    A lawyer is only necessary if the other guy has a lawyer. If we simply remove them no more problem. The amount of money or number of lawyers that you have should never determine the outcome, but in our system today it is essentially the only thing that does.

    Hate to break it to you, But Lawyers are a prime target for AI to replace. The more technical knowledge your job requires you to know or worse yet research.     I understand US police are essentially immune to perjury charges. On books they aren’t suppose to, but they are almost never prosecuted for it. Thus US police do something one officer calls “testalying”. It has become standard practice for police to lie through their teeth on the stand and make up whatever they want.

    The very last question about appeals may need further comment: After a trial (in state court), there is one appeal. But there are other ways of challenging a conviction. They are not technically “appeals” but are often referred to by that term. Some of those proceedings can result in appeals of their own. And then the original defendant enters the federal arena with federal constitutional challenges to their conviction. Again, not technically an “appeal” but to those not versed in federal procedure, it may seem like one.

    Regarding “knowing every law”, you can think of it like another insanely complicated field like medicine. Just like doctors, lawyers like to specialize in one area. There are lawyers that can handle common legal issues, like there are General Practitioners, but if your specific problem is beyond them they will refer you to someone who specializes in that field instead.

    Lawyers can specialize in even seemingly overly-specific areas too, like DUI (or DWI or whatever it’s called in your area) defense. Plenty of lawyers out there who handle nothing but divorce cases. Just like a doctor that specializes in disorders of the foot, or the jaw, or eyes.

    I’ve heard another reason for statue of limitations laws, which is that with enough time, a person who committed it may have changed and isn’t like that anymore, and that the state would rather prosecute people who are currently problematic than someone who did something 20-30 years ago and changed for the better.

    Devin should do a video on pleading the 5th. I have heard that you should plead the 5th if you get arrested or accused of a crime, even if you are innocent. The reason is that law enforcement or the prosecutor could twist your words to make it look as if you were implying guilt to that crime when you are not. At least don’t talk until you have legal representation ready to help you navigate those waters (#notlegaladvice because I’m not a lawyer) but that’s what I have heard. Having said that, some people think that pleading the 5th implies or creates an impression of guilt. But, since it’s a law against self-incrimination, wouldn’t the presumption of innocence still apply until found guilty by a jury of peers?

    I was on a grand jury once and yes, we heard that ham sammich saying many times. As we were instructed by the prosecutors, our job wasn’t to determine if someone had enough proof or how it would be proven if someone was guilty. It was two things. 1. Was there a crime committed? 2. With the information you have been given, is it reasonable to assume that this individual did this crime?

    I get annoyed at anybody being considered “allegedly” is seen immediately as absolutely fact. It’s like people forget that they hate cops, but suddenly agree with them when somebody is called something. Too many people get in trouble for things not truly convicted of, only to then be found correctly innocent when it’s too late.

    – It is the responsibility of the Prosecution to prove “beyond reasonable doubt” that the accused is guilty of the crime and all elements constituting the crime are present in the case.

    Also, it is the jury who will decide whether that person is guilty or not and just everyone else…

    On the note about defending obviously guilty people: the whole reason the court system exists in the first place is to try and establish the truth without violence. Before courts, people could be punished over so much as a simple rumor. The job of a defense lawyer isn’t to try and get their client a “not guilty” verdict; it’s to ensure the prosecution did their job correctly by verifying things like that they first obtained legitimate evidence, obtained it in an ethical manner, aren’t accusing the accused of additional crimes they did not commit, etc. The American legal system, while it has its flaws, was established the way it was to try and protect the rights of the innocent above all else, hence the saying of “innocent until proven guilty (in a court of law)”. Everyone has a right to a fair trial for that very reason, regardless of what evidence comes up. The accused is not officially guilty until the court deems it so, because it’s their job to verify everything first.

    I actually agree with the sentiment of AI in law. The way it is likely to be handled is AI will be used as a tool, not a replacement. Same with Doctors too. The speed at which it operates can help diagnosis in medicine and help with as he said “the drudgery” of law practice.

    6:33 my theory on this is that personal injury cases are a sweet spot for attorneys.

    SSDI applications, probate and writing wills (for most people) are fairly easy, but they don’t pay all that well. Business law pays really well but it’s a very specific very time consuming. Personal injury isn’t too hard, but firms can also make bank.

    If for instance, you agree to settle for your policy, and you have purchased 100k in personal injury protection. The law firm gets 1/3 of that. That’s enough or almost enough to pay one staff member for the entire year.

    As someone who has a Perjury conviction under their belt, I can say it is absolutely enforced. I was charged with felony perjury, got it reduced to a misdemeanor and I can say it has and still does cause many many problems in my young life lmao.

    I find the history of law very interesting.     I imagine most AI things you’ll see are going to be assisting normal technology and/or people, not taking them over. At lest, for a while, as nothing has the body to accomplish normal human processes and things change. You can know an entire library on a topic and still run into a thing that no one’s thought of. Then there was that case where an AI lawyer literally took a case and just kinda… bombed, for lack of a better word. There’s also case after case you can locate out there of AI having issues (there was one time where an AI cop ran into a woman who claimed a crime and it told her to go away and sang a song). The fact is that computers can only do what they know, even if it seems random (it’s technically called “pseudo random) and that means that as long as human beings exist, we will continue to make weirder and more random questions that will require human beings to answer them.

    Also about pleading the fifth: as a layman, I’d say it’s not just about being innocent; it’s about not appearing guilty. Maybe you didn’t do it, but you still were… close to the crime scene… or had an argument with a (murder) victim… or had a motive… or don’t want to reveal you cheated on your spouse…
    So you might look guilty while being innocent.

    On the A.I. song question:
    Seeing as it is the distribution of intellectual property which is the issue the distributer or ‘persons who caused the distribution’ would be liable. Using an AI to create a song in the style of the artists will probably eventually be acceptable to do but monetizing or distributing will probably strictly controlled. Unlike a human made remix which injects a lot of fair use considerations I believe most A.I. art is not considered to be copyrightable as no human made choices resulted in the art.
    Basically as far as I can tell, current AI can take the same exact prompt and make 1,000,000 images which are quite similar but not the same, the act of a human choosing the one they think is the highest quality and posting the image/remix seems to not be enough creative input to be copyrightable. The most you can copywrite as an A.I. programmer is the A.I. model which creates those specific images.
