No physical injury is required, but the actor must have intended to cause a harmful or offensive contact with the victim and the victim must have thereby been put in immediate apprehension of such a contact.

    “Intention” in the context of assault, means that the act is not accidental, but motive is immaterial.
    It does not matter if the goal of the tortfeasor was merely to scare the victim or if the act was meant as a joke.

    “Reasonable apprehension” in the context of assault, refers to the victim’s reasonable belief that the act will lead to imminent harmful or offensive contact.

    There is some disagreement among jurisdictions in regard to the role of consent.

    The prima facie case for assault has three components:

    The defendant acts.
    The defendant intends to cause the victim to apprehend imminent harmful or offensive contact by the defendant.
    The defendant’s act causes the victim to reasonably apprehend such a contact.

    In tort law, assault is considered an intentional tort. Some jurisdictions label assault as attempted battery. Assault is typically paired with battery as assault and battery.

    In assault and battery, assault refers to the act that causes the victim to immediately apprehend a harmful or offensive contact, whereas battery refers to the act that causes the actual contact.

    Assault committed under aggravating circumstances may be raised to aggravated assault.

    I appreciate how Draymond continues to genuinely apologize for the punch. No one, including Draymond, condones this action. Watching the video I honestly wondered: why no sound? What led up to the incident? He will keep moving forward (past this mistake) regardless of the “angelic” trolls who keep posturing in the comments like they are Judge Judy. GSW 2023 CHAMPS!

    Draymond, how can Jordan Poole move on from your bad behavior if you continue to do a press tour talking about it? He was the victim, not you. Allow this young man and your team the time necessary to heal and please move on and be the professional you claim to be!

    The problem with every interview people will ask him why did it happen? The team is saying let’s keep it in house but he’s a media personality as well as a player he has to speak in a way that respects the fact that the team wants to keep it in house. That means Draymond can’t say he said this, I said this and he pushed me and I hit him and this is why it started. He already had these interviews scheduled so no he’s not on an apology tour it’s just timing.
