    The 2nd is meant to keep parity with the government. That’s the whole point – to keep the government in check.

    The police exist for blue collar crime. DOGE exists for white collar crime. DOGE should be institutionalized.

    In regards to DOGE, there comes a time where you must break the law to enforce the law, because the law is not perfect on earth. The man even said in his previous answer, literally, that the system isn’t perfect.

    Something for thought: No one really agrees on what the function of the criminal justice system is. Does it exist for punishment? Rehabilitation for offenders? To make society safer as a whole? To make the families of victims feel better? Those things often conflict with one another, yet we kind of pretend we do them all at once. One can argue that by doing so, we do a poor job at all of them.

    Some courts still ask witnesses “Do you swear to tell the truth… so help you god”.
    As an atheist, if I answer “yes”, and then it is discovered I’m an atheist, can a DA or judge, having a bad day, punish me for lying about the oath itself? Be it perjury or something else?
    Can I legally answer “No, but I swear to tell the truth.”?

    So why can’t we have a federal Rico trial for the Jan 6th crowd?

    Everyone that was pardoned – we could have wrapped that entire mess up within a year of Biden taking office if the govt had chosen to put their foot down. It may not be the mafia, but every single one of those people used channels of communication to organize and specific people such as the leader of the proud boys would’ve been held accountable as organizers of treasonous groups.

    Could’ve had them all wrapped up in a bow.

    1:46 I was told the following by an acquaintance that works in criminal law and her take has always stuck with me since then: every lawyer’s, especially public defenders’, job first and foremost is to ensure their client is subject to a fair and just trial in order to get the fairest probable outcome. That doesn’t necessarily mean they win their case, but that the final judgement takes all facts into consideration and that (at least the spirit of) the law is upheld. That being said, she also made sure to stress that procedural regulations aren’t always the best, as in our country Germany, there is also a chance that your assigned public defender specialises in a completely different aspect of the law such as e.g civil or family law and then is your only available option at representation in a criminal court. Another was that a dismissal of the judge(s) due to bias needs to be approved by the judge first which of course isn’t likely to happen if they truly are biased. I think law can be really fascinating if frustrating like that.

Congress is absolutely not the only thing that can create or approve a new department, this is known to anyone who actually pays close attention to politics or how the country works, a simple google search will tell you this.     If Luigi doesn’t get charged with premeditated first degree murder, it will be a severe miscarriage of justice. None of his motives excuse his actions. Even if you agree with the overall outcome, the way he went about it could easily be applied to situations you wouldn’t agree with, and It didn’t actually change anything. Maybe a few CEOs hired security, and that’s it. Everything went back to the same except for now there are some children without a father.

    I’ve been addicted to watching police bodycam vids. In it, self-proclaimed legal experts have claimed that their arrests are invalid because they weren’t read their Miranda rights. Law enforcement obviously laughs it off, noting that it would only apply to whether or not any answers to questions could be used in court. A lot of times it’s really for DUI cases or other cases where the actual crime is apparent in video evidence and any confession is probably not going to matter.
