Former FBI agent and body language expert Joe Navarro breaks down how he approached interrogating during his time with the FBI. Joe sets the record straight; there is no simple way to tell if a human being is lying. When looking for deceit, Joe focuses on the subject’s discomfort. He also does is best to make sure the subject feels comfortable enough to open up…a far cry from the images we see in many police procedurals.

Great interview spoiled by stupid editing. You don’t need to cut a way to an image or a video of all the things he is saying. I’m trying to thing about the topic, but now I’m distracted with a lumberyard. I’ve seen a lot of channels doing it. What a stupid trend.

At last, a refreshing truth after all those TV experts have come on analysing those found to be guilty AFTER the fact. They never analyse anyone proved innocent because they would probably exhibit exactly the same behaviour.

The danger now, as it has always been, is that the suspect is telling you just what you want to hear. In other instances, the suspect might begin to believe what he’s accused of, a form of ‘Stockholm syndrome’. That’s why an honorable interrogator will not jump at a helpful turn in the cover story, giving equal effort to absolve the accused as to convict them…

Remember, the 5th amendment gives you the right not to answer any questions during an interrogation. Refuse to answer all questions. Demand to speak with a lawyer. Using your 5th amendment rights is not a sign of guilt. If an agent knocks on your door without a warrant, ask them to leave a business card behind and tell them you’ll have your lawyer call them. Never open the door. If they present a warrant, make sure it’s valid and that a judge has actually signed it. Law enforcement will lie for any reason at any time.

This is so refreshing to hear, as someone on the Autistic spectrum it terrifies me to think that people put so much stock in body language and non-verbal communication, because most of the time I’m completely blind to it. It very rarely occurs to me that people would be lying if it isn’t something I would lie about myself. If I ever get arrested, whether I’m innocent or guilty I’m not saying a WORD until there’s a lawyer AND an expert in neuro-divergence present. I know I read as “awkward and weird” even when I’m relaxed, I’m not having that used against me.

There was this horrible pop-psychologist rocking around in the 1990s who had all sorts of claptrap about “body language”. He seems to have disappeared now after selling a bunch of books. Carl Jung had a client who amongst other things complained that the birds were constantly attacking her. Jung was trying to understand the symbology of birds to her case. Then after one interview, he was walking near her, outside, and several birds attacked her.

I really like the discussion of non-verbal cues here. There are very good reasons you can’t use them as evidence – they’re just not reliable enough. Different people communicate differently, and you can’t convict someone just because they look shifty when they’re telling the truth.
But, in the moment, an investigator can use them to inform the direction they focus their efforts in. It’s like in science: a researcher uses their intuition to decide which experiments to run, then they publish the results of the experiments (whether their intuition was correct or not)

First rule of talking to cops: DON’T!
Only do what is compulsory, here, in this example – according to federal law
Unfortunately in the US cops CAN lie to the person being interviewed/interrogated. It is not an offence for a cop to lie and doesn’t matter if it’s federal or state law. In the UK cop lying to the person which they have an encounter of any type this is breach of Code of Conduct, Code of Ethics, and some acts I cannot recall while writing this so
BE THE SAFE MINORITY – DON’T TALK TO THE POLICE. YOU ARE NOT OBLIGED TO PROVE YOUR INNOCENCE, IT IS COPS’ JOB TO PROVE YOU GUILTY.
When Arrested YOU HAVE THE RIGHT TO REMAIN SILENT – this is VERY GOOD advice, USE IT!

I don’t agree that the best liars are constant. Maybe habitual but lying too much is easy to detect and if you aren’t careful you get detailed with a lie and are able to be proved false. The best liars I know pepper in the truth on top of their lies so when you look at the evidence because a few details match up, people will assume the rest matches up.

The “what airport did you land at?” question is bad because I can never remember the official name of an airport. Like,
“Oh you went to Barcelona? Which airport did you land in?”
“Errr… Barcelona Airport?”
“Aha! You meant Josep Tarradellas Barcelona-El Prat Airport. Lock him up bois!”

When you about to be tortured instead of telling the truth, LIE. There is no such thing as a lie detector in REALITY. A lie detector is a simple mentalist trick. Don’t be fooled. Say and pretend that you believe in it and act afraid of telling a lie, ask questions for them to be more specific “because it could be a yes and no at the same time”” so when you start lying they will believe you.

I like how he calls them bad techniques when the point of them is to get the answer you want. You crowd them, harrass them, and make them uncomfortable to get them to talk. They are great techniques to get a conviction. A chainsaw is a great tool for cutting out someones heart… unless you wanted it for a heart transplant.

As an addict in recovery I was also an experianced deciever. The best of lies wouldn’t fool even the most gullible of people without charisma. To get a person thinking ” he doesn’t seem like the type of person who would lie.” And always stick to as much truth possible. Don’t try explaining every detail to sound convincing but rather let that person make those connections themselves. I just hit 11 years clean and sober and that’s actually the truth! This guy should be training field agents. A friend, and previous employee of mine, required a background check for his job. He told me that the agent would be stopping at his old job at the grocery store first, and then meeting me at the coffee shop. When I met the woman doing the interview, she was extremely serious, so I tried to lighten the mood. I told her that she should have picked up a coffee and scone at the grocery store because the coffee I had wasn’t nearly as good. Her eyes got real big, and she became visibly agitated and said…. “Are you having me followed??” “How did you know I was at the grocery store??” I told her that my friend had told me just in case she was late getting to our appointment. That answer made her even more paranoid, so for the rest of the interview she treated it like an interrogation. LOL Big mistake. I don’t bow to “authority”, so me being me I kept saying weird things simply to keep her wondering. I told her that his hobby was photography. HAHAHAHAHAHA. That was such a fun conversation. She was such an idiot. Thank goodness my friend got the job, no thanks to me. 🙂

He relied way too much on science over instinct. Which would be appropriate if we’re discussing molecules but we’re discussing something that can’t be accurately measured by science. An old ‘cop,’ that doesn’t rely on instinct isn’t worth his salt. I would hope each and every investigator takes an internal poll of what his instinct told him through the years, and tallied that up with if he was correct in the end. If he was incorrect too many times, I would hope they resign. If he was correct the vast majority of the time, he should take that as confirmation his instincts are sharp and rely on them more. But to shun your own instinct acquired through many years and thousands of investigations in lieu of “science?” If I’m an FBI director I don’t want him on my team. I want the guys with sharp, accurate instinct.

1: No or weak alibi? Always a lawyer, regardless guilt/innocence.
2: Once a lawyer is present you have to talk. But don’t blabber about; Don’t embroid your answers. Be verbally anorectic – short and to the point. Think 3-5 seconds before answering. Follow your lawyers advice.
3: If guilty – don’t appear smug or too self-confident. You play innocent – play that role well and to the point. Don’t overplay.
4: Never e v e r confess a crime to the police. They can lie about “overwhelming evidence” IF they think your guilty, regardless your innocence. If you ARE guilty – don’t confess anyway. Just don’t do it. Just say “take your evidence to the DA”.
